Terms of Service

1. Agreement
These Terms of Service govern your use of incook-e.com (the "Service") operated by Cook-e SAS ("the Company," "we," "us," or "our") (14 Rue de la Banque, 75002 Paris, France). The Company builds and commercialises an AI-powered unattended hot food cabinet that uses vision-based doneness and timing control, targeting transit hubs, offices, and late-night food operators. By using the Service you accept these Terms. If you do not accept them, do not use the Service.
If you are a consumer (a natural person acting outside your trade, business, craft, or profession), nothing in these Terms limits your statutory consumer rights under the laws of your country of residence.
2. Use of the Service
- You must be at least 18 years old or have the consent of a parent or legal guardian.
- You agree not to use the Service for unlawful purposes, to interfere with its operation, or to attempt unauthorised access to its systems or content.
- You may not copy, scrape, or reverse-engineer the Service or its content except as expressly permitted by mandatory law.
- Enquiries and early-access requests submitted through the Service must be truthful and relate to genuine operator deployment interest.
3. Intellectual Property
The Service, including all content, copy, imagery, diagrams, and software, is owned by Cook-e SAS or its licensors and is protected by French and EU intellectual property law. You receive a limited, non-exclusive, non-transferable licence to access and use the Service for its intended informational and enquiry purpose. No ownership or sublicensing rights are transferred.
4. User Content
You are responsible for any content (including operator enquiry details and contact information) you submit through the Service. You represent that you have the necessary rights to submit such content and that it does not infringe any third-party rights. You grant the Company a limited licence to use, store, and process the content solely to respond to your enquiry or to provide the Service.
5. Right of Withdrawal (Consumer Contracts)
Where you enter into a paid distance contract with the Company as a consumer, you have the right to withdraw within 14 calendar days under the EU Consumer Rights Directive (Directive 2011/83/EU as implemented in French law) without giving any reason. To exercise the right, contact us at [email protected] with a clear statement of withdrawal. We will refund all payments received within 14 days of receipt of your notice.
The informational and early-access Service currently offered through incook-e.com does not include direct paid digital content; this clause applies only if and when paid services are offered and a distance contract is concluded.
6. Disclaimers and Statutory Guarantees
The Service is provided on an "as is" and "as available" basis. Nothing in these Terms excludes or limits the Company's liability for (a) death or personal injury caused by its negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability that cannot be excluded under mandatory French or EU law. Statutory guarantees applicable to consumers under EU law are not affected by these Terms.
The technical specifications displayed on incook-e.com describe the Cook-e cabinet's operating parameters. They do not constitute a guarantee of specific client outcomes; the Company is in early-access stage and does not publish aggregated cohort performance data.
7. Limitation of Liability
To the extent permitted by applicable law, the Company's total aggregate liability for any claim arising from or related to the Service will not exceed EUR 100, except for liability that cannot be limited under mandatory law (see Section 6).
8. Termination
We may suspend or terminate your access to the Service for material breach of these Terms. Sections 3, 6, 7, 9, and 10 will survive any termination by their nature.
9. Governing Law and Jurisdiction
These Terms are governed by the laws of France.
The courts of Paris, France have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, subject to the mandatory consumer-protection rules of your country of residence (Articles 17 to 19 of Regulation (EU) No 1215/2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters). If you are a consumer, you may also bring proceedings before the courts of your country of residence, and the Company may only sue you in those courts.
The European Commission provides an Online Dispute Resolution platform for consumers at ec.europa.eu/consumers/odr. The Company does not commit to using any alternative dispute resolution body but will cooperate where required by applicable law.
10. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted with a new "Last updated" date at the top of this page. Continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
